Building a kennel in your garden:what are the rules to follow?

If your dog does not adapt well to indoor life, or if you do not have the possibility of welcoming him into your home, you have the possibility of building a kennel for him if you have a garden. This enclosure, closed and well insulated from bad weather in particular, represents for your pet a place that belongs to him, where he must feel good and safe. Depending on the type of kennel you want to build, you must respect certain rules, in particular related to the town planning rules in force.

The rules in force to respect for the construction of a kennel

A kennel is intended to accommodate and offer one or more dogs a place where they are protected, in particular from bad weather. This type of construction must comply with sanitary rules respecting animal welfare.

It goes without saying that a kennel must be fitted out to guarantee a pleasant, functional and suitable place to live for your dog. It must first guarantee good hygiene for your pet. But this enclosure must also not cause nuisance to your close neighbors in particular, whether they are sound or olfactory. In the same way, you have to be very vigilant about the treatment of the droppings of your dog who lives in a kennel. The installation of a septic tank-type evacuation system independent of the main sewer network of the house is most often recommended.

If you are building a kennel for less than nine dogs, you are not subject to the legal obligations relating to the development of a kennel defined in the Departmental Health Regulations (RSD), a reference document for local authorities in matters of hygiene. These obligations require taking steps with the prefecture. However, these are standards that apply more particularly to professionals who breed dogs and who logically own many more than nine.

Is a building permit necessary to build a kennel in your garden?

Before starting the construction of an enclosure in your garden to install a dog (or more), that is to say a kennel, you must first ask yourself about the need or not to apply for a permit. to build with the town hall of your municipality.

This planning permission is indeed mandatory for any new construction and which forms a building independent of your house, even if it does not have foundations, from the moment its footprint is greater than 20 m 2 . The need to contact your municipality to obtain a building permit therefore depends on the planned surface of your kennel.

If you are required to apply for a building permit for your kennel due to its surface area exceeding 20 m 2 , you can do so by registered letter with acknowledgment of receipt addressed to your municipality or submit your request directly to the town hall. The building permit application form must be accompanied by a number of documents, the list of which you will find on the website of the Ministry of Territorial Cohesion.

If the enclosure for your dog is between 5 and 20 m 2 , a building permit is not required by local planning regulations. On the other hand, you must submit a preliminary declaration of work to your municipality. Note:this authorization is required for all new constructions, including a kennel, regardless of their surface area, if your house and its garden are located near a historic monument.

If the kennel you want to build in your garden does not exceed an area of 5 m 2 and a height of 12 m, the work you are going to carry out does not require an authorization request from your municipality.
